Usage Agreement

Terms of Service.

Thank you for using Tracer. The use of Tracer website, services, and software are subject to the following Terms of Service. Please read these terms carefully before accepting them.

Tracer Terms of Service.

This means that you or the company that you represent, (“You” or “Customer”) may use this agreement with Tracer Yazılım Teknolojileri A.Ş. (“TYT”) and specifying your rights to use the www.tracer.com.tr website and all related TYT products and services (“Tracer” or “Services”). Since all terms are important and form a legal agreement together, you must read these Terms of Service carefully before becoming a member of Tracer. By completing and submitting the Tracer membership form, you are responsible for these Terms of Service and this agreement becomes valid. If you are using Tracer on behalf of your enterprise or if you have the Administrator level access on Tracer to your company’s account, you also agree to these Terms on behalf of your organization and declare that you are duly authorized to do so.

TYT reserves the right to change or update the Terms of Service at any time without notice. You can always find and review the most up-to-date version of the Terms of Service on tracer.com.tr

You must be a human and of legal age in the country of your residence to accept these terms and to use the Service. Automated user signups or accounts intended for use by automated systems are not allowed under these terms.

In the framework of this agreement, by accepting these Terms of Service, you assure that the name, surname, e-mail address, billing information and any other information you provide to TYT are correct, legally accurate and valid. In case of any change, you are responsible for keeping this information up-to-date.

Your username and password can only be used by one person. It is permitted to share your username and password with others.

You are responsible for maintaining the security of your username and password. If you fail to fulfill this security obligation, TYT is not responsible for any harm or any loss of information and cannot be held responsible.

If you believe that your username or password has been seized or learned by someone else, you should immediately change your password from a secure terminal and alert us and other users whose information may have been compromised due to this exposure.

You may not register or access the Service using any method other than teamgram.com website or other authorized communication channels. Automated registration or access methods are not permitted.

All activities, made by using Tracer, must be constitutional according to the Constitution of the Republic of Turkey and also comply with the laws and regulations of the country where you live and your company is connected.

Any content shared with you by other users of the Services is transferred to you as-is and is for your personal use only. Using, copying, reproducing, transferring, distributing, publishing, selling, licensing or other use of such content without the consent of the content owner is prohibited.

You may not use the Services for any purpose other than your authorization or for any illegal purpose. By using the Services, you accept the laws and regulations of the country you live in, the Republic of Turkey and you agree to not violate the copyright law.

You guarantee that the files and the content you upload while using these Services do not contain or install any viruses, worms, malware, Trojans or other harmful or destructive content.

Your use of the service is at your sole risk. The service is provided on an AS IS and AS AVAILABLE basis.

You understand and agree that TYT works with business partners and third parties for various segments including hardware, software, servers, networks, substructure, data centers, internet connections and support elements to provide these Services.

You understand and agree that the following activities, but not limited to, are specifically prohibited:

• Attempting to access, modify, disrupt, and interfere with the parts that are not accessible to you.
• Using Tracer to distribute malware, or to direct others to malicious websites, and breaching other people’s security of data in any way. Uploading infected files, embedding malicious scripts or saving links of malicious web sites are considered among such activities.
• Trying to discover system vulnerabilities, violate security mechanisms or neutralize any protective measures. Scanning and testing communication ports, automated serial login attempts, etc. are considered prohibited activities.
• Accessing system resources in a way other than our website and permitted communication methods.
• Uploading and downloading to the system using clients, intermediate software and services which are not authorized by us. To scrape, reformat and modify the content for a different purpose are considered as prohibited activities.
• Modifying, adapting, collapsing and trespassing these Services, or making false statement that another site is related to these Services without TYT’s written consent.
• Using Tracer for unauthorized transfers.
• Using Tracer to falsify or hide your identity, send deceptive information.
• Sharing or distributing infringing, misleading, false, fraudulent content that violates the rights of others.
• Using the trademarks and names of others without permission.
• Reselling these Services.
• Storing, sharing, sending any illegal content or engaging in any illegal activity. 
• Storing, sharing, or sending content or engaging in any kind of activity that encourages, promotes, or facilitates religious, ethnic, or racial hatred.

 

You understand and agree that some of your content may be transported or stored over public channels without being encrypted, in order to provide the technical requirements of the connected networks or devices.

Tracer subscription is purchased and paid on behalf of your company. Users with Administrator rights in your company may grant or revoke rights to other users as needed.

A valid credit card and/or prepayment is required for the Tracer subscription. By subscribing to Tracer, you agree to pay TYT or our designated payments processors periodic subscription fees indicated for the Service. Payments will be charged at the beginning of each period and are not refundable.

When you start a Tracer subscription, your free trial ends automatically and you are billed for the first period of use.

Unless you inform TYT that you want to cancel your subscription before the end of the current service period, charges will be automatically charged to your credit card when the time comes.

No refunds or additional credits will be given for the months of missing usage, change of subscription or months of non-use with an open account.

Any change you make to your subscription becomes valid immediately.

All prices do not include taxes and are the responsibility of the customer for the payment of additional taxes.

This service is offered in Turkey and billed according to the legislation of this country.

Once your company account is suspended, your information will be protected for ninety (90) days from the date of suspending. If you decide to enable your account during this time, you will be able to access your information after you have paid for the subscription.

If you do not enable your account during this period, all your information may be deleted and may not be restored at the end of this period.

The customer is responsible for the correct cancellation of his / her account. Requests for cancellation of subscriptions sent by email or telephone are not applicable. The subscription can be canceled at any time by using the unsubscribe link in the Control Panel menu. If you cancel your membership in the middle of the service period, the cancellation can be put into process immediately and you will not be billed again.

TYT may deactivate your company’s account or block access to the entire account or any part of it with or without notice, at any time. In this manner, closure of the services may lead to your account is being suspended or deleted, blocking you from accessing your account, and waiving your rights to all content on your account. TYT reserves the right to not serve any person for any reason.

TYT may change the Services or may not maintain the entire service or any part periodically or consistently, with or without notice. TYT cannot be held responsible for any changes or interruption on Services as described in this Terms of Service.

TYT reserves the right to change fees or terms of payment giving 30 days’ notice. It will be announced on www.tracer.com.tr or through the Services.

Copyrights, Trademarks, and Claims of Infringement

If you find out that any content on Tracer is infringing a copyright or registered trademark, notify us by filling a feedback form. Be sure to provide the following information:

• Your copyrighted work or registered trademark
• The content that infringes it, report the URL, if possible.
• Your name, corporation (if any), e-mail, phone number, legal postal address.
• Indicate that you own the copyrighted work or registered trademark
• Request removing of this content from Tracer.

 

Advertising and Sponsorship

We may collaborate with advertisers or sponsors to subsidize the cost of your service. You declare that you understand that the price of this service would be much higher without advertising and sponsorship revenues and that you consent to our collaboration with advertisers and sponsors to keep the price low. You should not block the advertisements on the Tracer website and in any e-mail, we send to you. To reduce the display of advertisements that may not interest you, we may use some profile information that you and other users of your company have entered into Tracer.

If we work with other advertising networks and partners for ad impressions and sponsorships, we may share certain information about you and your company with these organizations, but we do not reveal your identity. Your contact information, your names, phone numbers, e-mail addresses, files are never delivered to advertisers and sponsors.

We are not responsible for the messages of advertisers and sponsors.

Limitation of Liability and Warranties

Services are provided as they are, TYT, and its suppliers and licensors do not guarantee that, including but not limited to, salability, infringement, and expediency of services.

TYT, its suppliers and their representatives do not guarantee that including but not limited to;

• Services are errorless
• Accessing services is without interruption and continuous
• Services will satisfy your specific demands and needs
• The quality of the services and the products will meet your expectations
• Any error in the services will be corrected

 

TYT, its suppliers and representatives may deactivate or limit your use of the Services, in whole or in part, for maintenance and repair, updating, or for any other reason, with or without notice, at any time. TYT is not responsible for any interruption or loss of information that may occur during this period.

TYT, and its suppliers, and licensors, under no circumstance referring to any contract, negligence, liability, or other legal theory for the works described in this agreement, are not under obligation for (i) no special, direct or indirect compensation; (ii) suppliance of equivalent products and services; (iii) interruption of use, loss or corruption of data; or (iv) any payment exceeding the amount you pay for such services to the TYT or its designated payment provider up to 3 months earlier. TYT has no liability for matters that are not under its control. All of the above applies to the extent permitted by law.

The fact that TYT does not apply any of the clauses specified in these Terms of Service does not mean that the clause is invalid. The Terms of Service includes your use of the Services and constitute an agreement between you and the TYT, including but not limited to, any prior agreement, which invalidates previous versions of the Terms of Service.

We, our employees, managers, representatives, suppliers are not liable for any direct or indirect damages (including but not limited to; loss of profits, data loss, unauthorized access, attorney fees) and our total charge is limited to payments that you made during ninety (90) days before claim compensation.
